A greve geral dos trabalhadores da Funpar/HC, iniciada às sete horas desta segunda-feira, 09, vai para dissídio. A audiência, no Tribunal Regional do Trabalho, foi marcada para amanhã, às 14 horas. No entanto, a paralisação não foi declarada ilegal ou abusiva e está mantida.

O Sinditest-PR foi notificado por voltas das 10 horas da manhã de hoje, por telefone, enquanto organizava os trabalhadores em um ato em frente à reitoria da UFPR. Os funcionários da Fundação cruzaram os braços depois que a Funpar se negou a negociar com o Sinditest-PR o acordo coletivo de trabalho da categoria.

O comunicado aconteceu após os trabalhadores se mobilizarem em frente à entrada principal do prédio da reitoria. Na sexta-feira, 6, a administração da UFPR havia anunciado a realização de um entrevista coletiva na manhã desta segunda-feira para tratar do tema. Várias equipes de TV estavam no local. Quando o advogado da Fundação, Luiz Antonio Abagge, chegou para acessar o prédio, os funcionários terceirizados que fazem a guarda do edifício não abriram a porta, receosos de que os trabalhadores ocupassem o local.

Abagge acabou falando com a imprensa do lado de fora, rodeado de bandeiras do Sinditest-PR e de manifestantes que gritavam palavras de ordem.

Os acontecimentos das primeiras horas da manhã fizeram com que a reitoria marcasse uma reunião de emergência com a diretoria do Sinditest-PR e com a comissão de negociação do acordo coletivo da Funpar/HC para as 10h30.

“Hoje, nós já tivemos uma vitória”, anunciou o assessor jurídico do Sinditest-PR Avanilson Araújo aos trabalhadores, naquele momento. “Tiramos o Abagge daqui e não permitimos que ele mentisse junto ao reitor”, completou. “O reitor também marcou uma reunião para daqui a pouco. Se não reconhecesse o sindicato, não marcaria.”

Reunião teve início tenso
A reunião das 10h30 aconteceu no Hospital de Clínicas e envolveu uma comitiva do Sinditest-PR, o reitor Zaki Akel Sobrinho, o advogado da Funpar Luiz Fernando Abagge, o superintendente do HC, Flávio Tomasich, e representantes de demais setores do hospital. Ela foi filmada pela reitoria. Durante todo o tempo, um segurança se manteve na porta da sala que abrigou as discussões.

O reitor abriu o encontro dizendo que esperava uma determinação da Justiça para voltar a negociar o acordo coletivo. “Nós não temos preferência nenhuma. Nós não temos nada a ver com essa imbróglio entre Senalba e Sinditest-PR”, disse. “Vamos fazer o que a juíza determinar.”

Com uma publicação distribuída pela administração da UFPR em mãos, Avanilson Araújo acusou a reitoria de adulterar documentos para confundir a categoria Funpar/HC e esvaziar a greve usando dinheiro público. “Isso é improbidade administrativa”, atacou.

“A greve pode acabar em meia hora, se vocês quiserem”, propôs. “É só vocês reconhecerem o Sinditest-PR e reabrirem o processo de negociação do acordo coletivo.”

Ao longo da reunião, os ânimos esfriaram e o próprio reitor Zaki Akel reconheceu a legitimidade do Sinditest-PR. “Eu não tenho dúvida de tudo o que vocês falaram, de que o Sinditest-PR é mais presente e mais atuante na vida dos trabalhadores Funpar/HC”.

O reitor alegou, no entanto, que no momento se sente intimidado pela decisão da 8ª Turma do Tribunal Superior do Trabalho.

Para Avanilson Araújo, na decisão não há nenhuma proibição de a reitoria negociar o acordo da Funpar/HC com o Sinditest-PR. “No que diz respeito ao HC, essa decisão pode ser acatada politicamente ou não. Nós temos interpretações diferentes sobre essa decisão. Isso pode gerar uma briga judicial de cinco anos. Até lá, os trabalhadores vão ficar sem acordo?”, questionou.

No decorrer das discussões, surgiu uma proposta que pode ser levada para a audiência de amanhã: Sinditest-PR e reitoria solicitariam à juíza para que as negociações do acordo fossem mantidas do mesmo que aconteceram nos últimos 18 anos, e as questões de representatividade em disputa com o Senalba seriam resolvidas apenas após a conclusão do acordo coletivo.

“Pode ser. Mas eu preciso de um tempo para pensar, para avaliar a situação”, hesitou o reitor, que prometeu dar uma resposta até amanhã, antes da hora marcada para a audiência.

Programação
Os trabalhadores Funpar/HC seguem em greve. Amanhã (terça-feira, 10), eles devem se concentrar a partir das 8 horas em frente ao Hospital de Clínicas. Às 11 horas, seguirão em passeata até o Tribunal Regional do Trabalho (TRT), onde acontecerá a audiência.
