Em defesa dos turnos contínuos e da jornada de 30h!

Aperfeiçoar a Resolução 56/11-COUN, visando à melhoria dos serviços prestados pela instituição e por seus servidores

Prezados(as) Conselheiros(as),

Graças à forte greve realizada em 2011, que atingiu os três segmentos da comunidade universitária (docentes, técnico-administrativos e estudantes), conquistamos melhorias diversas em nossas condições de trabalho e também na assistência estudantil. Os estudantes, por exemplo, contam desde então com a oferta de café da manhã (anteriormente os RUs serviam apenas almoço e jantar), além da oferta das três refeições também aos sábados, domingos e feriados. Os servidores técnico-administrativos, por sua vez, conquistaram naquela ocasião a regulamentação da jornada de 30h semanais, nos termos da Resolução 56/11, aprovada neste Conselho.

Ao adotar tal resolução, a UFPR cumpriu papel importante em nível nacional, confirmando a tendência já verificada por outras universidades: a de que é possível melhorar a qualidade dos serviços prestados pela instituição como um todo, otimizando o atendimento ao público com a realização de turnos contínuos de 12h e jornada flexibilizada de 6h. A partir de então diversas outras instituições federais de ensino superior seguiram o mesmo caminho, e os processos de flexibilização da jornada se generalizaram. Destacamos, como exemplos, os casos da UTFPR, cuja flexibilização se deu em 2012, e o da UNILA, cuja regulamentação acaba de ser aprovada.

Não ignoramos o fato de que nossas universidades, de modo geral, enfrentam o grave problema de carência de pessoal, o que, a propósito, obriga as universidades a explorar cada vez mais a força de trabalho de seus próprios alunos (bolsistas), de servidores já aposentados (bolsa sênior) ou de trabalhadores terceirizados, contribuindo assim, involuntariamente, para a consolidação das políticas de precarização do trabalho adotadas pelo atual governo.

Não acreditamos, porém, que a carência de pessoal e os problemas a ela relacionados (aos quais devemos acrescentar as dificuldades oriundas dos sucessivos cortes orçamentários) possam ser suprimidos ou mesmo amenizados com a mera elevação da jornada dos servidores estatutários. Com efeito, a elevação arbitrária da jornada de trabalho com a instituição do “ponto eletrônico” produziria, pelo contrário, queda da produtividade, uma vez que generalizaria a insatisfação já existente, decorrente dos baixos salários e do peso que os trabalhadores já têm sobre suas costas, dadas as contradições do subfinanciamento e sucateamento.

Noutras palavras: a Universidade não tem nada a ganhar rendendo-se à pressão dos órgãos de controle. E, de fato, ela não precisa se render a essa pressão: a Constituição Federal, em seu artigo 207, garante à Universidade autonomia didático-científica, financeira, administrativa. Ou seja, as recomendações de tais órgãos são, precisamente, “recomendações” — não precisam ser acatadas cegamente.

A Universidade ganhará, pelo contrário, se for capaz de convencer os servidores técnico-administrativos a zelar pelo cumprimento da jornada flexibilizada de 30h semanais (nem mais, nem menos), a colaborar para a instituição dos turnos contínuos, a zelar pela assiduidade, pela exposição dos horários de atendimento de cada unidade ou repartição. Tais medidas, a nosso ver, certamente elevariam a produtividade do trabalho, uma vez que os servidores teriam qualidade de vida e condições de trabalho superiores. Para atingir tal objetivo, entretanto, necessitamos repelir a prática de assédio moral, o terrorismo psicológico, as ameaças e insinuações que acompanham o furor pelo ponto eletrônico. A Universidade Federal do Paraná não seria o que é se nela as pessoas não trabalhassem. Precisamos dizer para a sociedade: sim, aqui as pessoas trabalham, e muito. As exceções não podem fazer com que aceitemos o discurso daqueles que desejam desmoralizar as universidades públicas (com o objetivo de melhor parasitá-las ou de expandir o domínio do ensino superior privado).

Em vista de tais argumentos, e com o propósito de ampliar o atendimento ao público, melhorar a qualidade dos serviços prestados, instituindo ambientes e relações de trabalho saudáveis, propomos que o Conselho Universitário aprove as seguintes alterações na Res. 56/11:

PROPOSTAS DE ALTERAÇÃO DA RESOLUÇÃO 56/11-COUN

(1) No Art. 5°, retirar menção explícita ao ponto eletrônico. Substituir por:

“O controle de assiduidade e frequência será feito nos termos da legislação vigente.”

(2) No parágrafo primeiro do Art. 1°, retirar menção sobre proibição de flexibilização para servidores que detêm FG;

Sabe-se, com efeito, que a detenção de Função Gratificada por parte do servidor está associada ao conceito de “dedicação integral” ou “dedicação exclusiva”. Ora, tal dedicação não está vinculada a uma jornada específica, pelo contrário, transcende a própria jornada, na medida em que o servidor por ser convocado a qualquer momento pela administração, dentro ou fora do período da jornada diária, não havendo razão, portanto, para se crer que dedicação integral seja sinônimo de permanecer 8h por dia no local de trabalho.

(3) No parágrafo primeiro do Art. 10, acrescentar que os servidores técnico-administrativos que farão parte da Comissão paritária para acompanhar a implementação da jornada de 30h devem ser escolhidos por seus próprios pares, isto é, eleitos em Assembleia Geral da categoria, organizada por seu sindicato.

(4) No parágrafo único do Art. 3°, alterar para:

“Os horários de atendimento ao público e as jornadas de trabalho dos servidores técnico-administrativos de cada setor serão organizados pelos próprios servidores, acompanhados pelas chefias imediatas, e submetidos à autoridade superior, devendo constar as escalas nominais em quadro de aviso afixado em lugar visível e na página da UFPR na internet.

(5) Adotar o ponto de vista defendido pela FASUBRA através de sua assessoria jurídica (Nota Técnica) onde se afirma que a flexibilização da jornada diz respeito à instituição de ensino como um todo, e não a cada repartição (elimina-se, assim, a controvérsia sobre se as repartições/unidades estariam cobertas pelos critérios legislação);

(6) No parágrafo terceiro do Art. 10, alterar para:

“Excetua-se o Hospital de Clínicas de submeter proposta já que o mesmo tem a jornada de trabalho flexibilizada para 30 (trinta) horas semanais, adotada e aprovada por órgãos de controle externo. A Reitoria da UFPR reconhece como legítima tal flexibilização, vigente no Hospital de Clínicas desde o final da década de 1980.”
