Nicolas Pacheco é absolvido; o militante sofria processo por lutar contra a privatização do HC

Saiu hoje, 15, a sentença que absolve Nicolas Pacheco – estudante e militante pela ANEL e PSTU – das acusações de resistência à prisão e constrangimento ilegal, pesadas contra ele desde o dia 28 de agosto de 2014.

O estudante fez parte da Frente de Luta Contra a Privatização do HC e foi detido de forma arbitrária por agentes da Polícia Federal que estavam dentro do prédio da Reitoria da UFPR. No fatídico 28 de agosto, muitas bombas, bala de borracha, gás de pimenta e lacrimogêneo foram utilizados pela Polícia Militar e pela PF para reprimir manifestantes que se opunham à privatização do Hospital de Clínicas, que seu deu pela aprovação da EBSERH.

Avanílson Araújo, da assessoria jurídica do Sinditest, comenta que ainda que haja recurso  contra a absolvição de Nicolas, é pouco provável acontecer alguma reversão da decisão. Para Avanílson a sentença fortalece a perspectiva de que lutar por direitos não é crime. “Tem que ser assegurado o direito de lutar, embora a gente esteja vivendo no Brasil um contexto de acentuar a criminalização dos movimentos”, defende.

Em outubro de 2014 foi lançado o Comitê Lutar não é Crime, uma frente contra a criminalização dos movimentos sociais que exigia o arquivamento do processo de Nicolas Pacheco e de demais militantes do Paraná e Santa Catarina presos por lutarem. “É importante reforçar que o Nicolas foi absolvido não foi por falta de prova, foi porque inexistiu a conduta criminosa no que diz respeito ao crime de constrangimento ilegal. Foi uma ação do movimento de massas, legítima de um estado democrático”, diz Avanílson.
