Do lado de fora da reitoria, Zaki recebe pauta local de greve; servidores rechaçam portaria que institui ponto eletrônico

zakifora638Do lado de fora do prédio da reitoria, o reitor da UFPR, Zaki Akel Sobrinho, recebeu no fim da manhã desta quinta-feira, 02, a pauta local dos servidores técnico-administrativos, que estão em greve desde o dia 29 de maio. No documento, dentro outros temas levantados, os grevistas pedem a revogação da portaria 1854/2015, que instituiu o ponto eletrônico para os técnicos – e apenas para os técnicos – da universidade.

Os servidores, que haviam saído há pouco de uma assembleia no Restaurante Universitário Central, pretendiam protocolar a pauta local na secretaria do gabinete do reitor, mas foram impedidos de acessar o prédio por seguranças. O reitor acabou descendo até a porta e recebeu o documento do lado de fora. “Na UTFPR nós fizemos isso na semana passada, sem nenhum problema”, lembrou Carla Cobalchini, diretora do Sinditest-PR. “Mas, veja, vocês estão sendo recebidos pelo reitor”, tentou justificar Zaki Akel, enquanto os servidores se acumulavam em torno da porta de entrada, ao vento e ao frio do fim da manhã.

Akel foi recepcionado por gritos de: “Não é mole não. / Eu quero ver o reitor bater cartão”. Ele prometeu para a segunda-feira, 06, uma primeira reunião de negociação.

Os servidores técnico-administrativos acreditam que a instituição do ponto eletrônico é o início de um ataque à jornada semanal de 30 horas de trabalho, que se acreditava, havia se consolidado dentro da universidade pela resolução 56/11, do Conselho Universitário. No entanto, os depoimentos de alguns técnicos mostram que, em muitos casos, há pressão das chefias contra a norma. “Todo servidor novo que entra na UFPR é assediado a cumprir 40 horas. As chefias os amedrontam, ameaçam com o estágio probatório”, disse André Silva, do Setor de Ciências Sociais Aplicadas.

Estratégia
Houve polêmica na assembleia da manhã, que discutiu a estratégia dos servidores para enfrentar a iniciativa da reitoria. Um grupo pequeno defendia a revogação da resolução 56/11 e sua substituição por outra proposta, elaborada pelo Fórum dos Representantes dos Técnicos Administrativos em Educação da UFPR (Fortae). No entanto, por ampla maioria, venceu a proposta que quer modificações pontuais na resolução. A revogação da 56/11, concordaram os técnicos, criaria uma espécie de lacuna jurídica perigosa. “A revogação é temerária. Qual a força que temos dentro do Conselho Universitário? Temos força para colocar a jornada de 30 horas de novo em votação?”, questionou Carla Cobalchini.

Entre os pontos que devem modificados na resolução estão a retirada da previsão de instalação do ponto eletrônico e a inclusão na jornada de 30 horas dos servidores que recebem função gratificada. Essa modalidade prevê dedicação integral. “Mas isso não significa que o técnico vá cumprir uma jornada de 24 horas por dia. Ele precisa estar disponível caso aconteça alguma coisa, mas não precisa estar todo esse tempo na universidade”, justificou Carla.

Parecer
A assessoria jurídica do Sinditest-PR produziu um parecer jurídico contrário à portaria que institui o ponto eletrônico. De acordo com o documento, a iniciativa, ao obrigar os servidores técnicos a baterem ponto mas desobrigar os docentes, fere o princípio da isonomia, da igualdade e da impessoalidade. “É discriminatório”, resumiu Josimery Mattos Paixão, advogada do Sinditest-PR.

Fora isso, o documento também seria nulo, por desrespeitar a resolução do Conselho Universitário que previa que uma política desse tipo seria implantada apenas após ampla discussão com os setores. Josimery atribui a “rapidez” de agora à operação da Polícia Federal que indiciou dez médicos por não cumprirem jornada no Hospital de Clínicas. “Na ânsia por demonstrar uma pretensa moralização da coisa pública, o reitor fez essa portaria a toque de caixa.”

Caso o parecer não obtenha uma resposta da reitoria, o Sinditest-PR vai recorrer ao Judiciário para tentar sua revogação.
