Sinditest-PR vai acionar Judiciário contra redução de adicionais de insalubridade no HC

A assessoria jurídica do Sinditest-PR estuda medidas para questionar na Justiça a redução do percentual por insalubridade pago a mais de 130 trabalhadores do Hospital de Clínicas (HC).

Desde 2014, a administração da UFPR vem reduzindo o valor do benefício concedido a servidores do hospital, de maneira paulatina. Em 2016, o ritmo foi acelerado e o corte se tornou mais abrangente. Apenas em junho, foram editadas 48 portarias com descontos no adicional. Na maioria dos casos, o percentual foi reduzido de 20% para 10% do valor do salário-base.

Dentre outros pontos, o Sinditest-PR questiona o fato de a UFPR promover as reduções de forma unilateral, sem nem ao menos notificar previamente os trabalhadores. “A modificação ou extinção do adicional de insalubridade é possível, desde que alteradas as condições laborais”, esclarece Josimery Matos Paixão, advogada do Sinditest-PR.

“No entanto, essa prerrogativa da universidade está submetida ao princípio do devido processo legal. É preciso garantir ao servidor prejudicado a ampla defesa, para que ele tenha inclusive a chance de reverter a medida. Por isso, é ilegal a forma como está sendo feita a redução do percentual no HC”, afirma ela.
