Sinditest-PR é contra a cessão de trabalhadores RJU para a EBSERH

Em meados do segundo semestre de 2015, o Tribunal de Contas da União (TCU) publicou um acordão orientando que, em 90 dias, todos os trabalhadores com vínculo RJU e que atuam nos Hospitais Universitários sejam formalmente cedidos para a EBSERH.

Para o TCU, a atual situação desses trabalhadores seria irregular, visto que estaria sendo ferido o princípio da “hierarquia”. Segundo o TCU, é preciso que os trabalhadores obedeçam a um único comando e, no caso das universidades que optaram por passar a gestão de seus hospitais para a EBSERH, a esta empresa que esses trabalhadores ficam subordinados.

Diante desse acordão, a diretoria da FASUBRA solicitou um parecer sobre o tema, recentemente divulgado. No parecer, a Assessoria Jurídica Nacional (AJN) coloca que não há como impedir, do ponto de vista jurídico, tal cessão. Isto porque, ela está prevista em lei (possibilidade da administração pública movimentar seus servidores).

Orientação
Para a Assessoria Jurídica Nacional, o acordão do TCU é apenas orientativo, por isso, a disputa pode e deve se dar no âmbito político. Para argumentar contra o não seguimento do acordão do TCU, as universidades podem e devem invocar a autonomia universitária. No caso específico da UFPR, o “famoso contrato de cogestão” prevê que não haveria a cessão institucional dos RJU, como o vinculo de matricula, entre outros.(Resolução 23/12 do COUN). Temos, portanto, argumentos políticos e contratuais para não acatar as orientações do TCU.

Na UFPR, não há nenhuma normativa ou discussão acerca do tema. Por isso a boataria no HC é grande. Todos sabemos que seria possível que trabalhadores da área administrativa fossem absorvidos pela área acadêmica da Universidade. No entanto, como ficaria a situação dos trabalhadores da enfermagem, do laboratório, da Fisioterapia, entre outros? Na UFPR seguir a orientação do TCU significa dizer que todos os trabalhadores seriam cedidos, indiscriminadamente para a EBSERH?

Direitos Ameaçados
Vale lembrar que quem optar pela cessão à EBSERH manterá salário, regras de aposentadoria e demais direitos adquiridos via PCCTAE (Plano de Carreira dos Cargos Técnicos Administrativos em Educação). Porém, tudo aquilo que temos hoje e que não está no Plano ou que a lei é dúbia, está ameaçado. Aqui entram a jornada de 30h semanais, o direito a afastamento para qualificações e capacitação (apesar de garantido por lei, depende de anuência da chefia), acesso ao RU, entre outros.

Por tudo isso, é preciso ficar atento
Que fique bem claro: a Fasubra e o Sinditest não têm nada contra os trabalhadores da Ebserh, pelo contrário, querem representar esses profissionais e lutar para que seus direitos sejam mantidos e/ou ampliados. O problema está no modelo de gestão da Empresa Ebserh, que em menos de um ano tem demonstrado diversas posturas antidemocráticas, ditatoriais.

Por isso, não é negócio para o pessoal do RJU migrar para a Ebserh. Vamos sim, juntos, unir forças, lutar não apenas por condições dignas de trabalho para o pessoal do RJU, mas também para os colegas da Ebserh, que acabaram de chegar e que estão sentindo na pele a dificuldade de diálogo com seus dirigentes.

Venham todos – trabalhadores RJU, Ebserh e Funpar – participar das atividades de paralisação nacional, programada para o próximo dia 24. A concentração está marcada para as 7 horas, com café da manhã, no pátio da Reitoria. Neste dia, poderão tirar dúvidas, apresentar denúncias, sugerir ações etc.
