Neste novo ano, trabalhadores(as) da UFPR, FUNPAR/HC, UTFPR e UNILA, juntamente com o Sinditest, continuarão a pleitear a reposição de trabalho no acordo de compensação pela greve do ano passado. As negociações com as reitorias das instituições, que avançaram a passos lentos na segunda quinzena de dezembro – em razão da proximidade do recesso de fim de ano e, no caso da UFPR, da posse do novo reitor – devem ser retomadas ainda no primeiro bimestre de 2017.
Na UFPR, o reitor recém-empossado, Ricardo Marcelo, havia marcado uma reunião com os(as) grevistas para o dia 22 de dezembro, mas cancelou o encontro. Nova reunião deve ser marcada para este mês. No último dia 19, a comissão eleita pela base para conduzir as negociações apresentou uma nova minuta ao então reitor da UFPR Zaki Akel Sobrinho, na qual defendia a reposição de trabalho, não de horas.
A medida foi uma resposta à proposta da Reitoria, oficializada em 14 de dezembro, que argumenta pela reposição em horas baseando-se em um parecer da Advocacia Geral da União (AGU). Após análise do documento, o advogado do Sinditest Henrique Krammer garantiu que não há recomendação explícita de celebração de acordos de compensação de horas. A interpretação depende da vontade política do gestor, de penalizar ou não os(as) trabalhadores(as) que lutaram por seus direitos.
UTFPR
No último dia 21, foi realizada uma reunião sobre o ponto dos(as) servidores(as) que aderiram à greve na UTFPR, no campus Curitiba. As duas propostas de reposição de trabalho elaboradas pela assessoria jurídica do Sindicato foram rechaçadas pelo reitor Luiz Alberto Pillati, a despeito da recomendação da Associação Nacional dos Dirigentes das Instituições Federais de Ensino Superior (Andifes), que orienta que as reitorias façam acordos com o movimento paredista e cita a celebração de acordos de reposição de trabalho. Anteriormente, o reitor havia afirmado que seguiria o posicionamento da Andifes.
Para a administração, que também interpreta de maneira patronal o parecer da AGU, só existem duas possibilidades: corte de ponto ou reposição de horas. O impasse deve ser resolvido em uma próxima reunião, pré-agendada para o dia 10 de janeiro. A mobilização segue agora para os campi, com assembleias locais sendo realizadas de 2 a 6 de janeiro. Uma reunião entre a direção do Sindicato e os delegados de base será convocada para o dia da reunião com a Reitoria.
UNILA
Até o momento, não há novidades na negociação na UNILA. Após várias reuniões em que a Reitoria disse entender a luta dos(as) servidores(as), não houve muito progresso. Nas ocasiões, o reitor Josué Modesto dos Passos Subrinho afirmou que ficaria na dependência dos acordos celebrados por outras universidades.
No entanto, o pró-reitor de Gestão de Pessoas, Thiago Cesar Bezerra Moreno, insiste na reposição de horas. Os(as) representantes dos(as) trabalhadores(as) e do Sinditest na UNILA aguardarão o retorno das férias do reitor, que ocorrerá em fevereiro, para dar seguimento à negociação. Devem favorecer os(as) trabalhadores(as) os exemplos de outras instituições que celebraram acordos de reposição de trabalho com os(as) grevistas, como a UFSM e a UFSCar.
Assédio pós-greve
Desde o fim da greve, em 15 de dezembro de 2016, o Sinditest tem recebido vários relatos de assédio por parte de chefias contra os(as) trabalhadores(as) grevistas.
A greve é um direito de todo(a) trabalhador(a), previsto na Lei 7783/89 e na própria Constituição Federal. Todos os critérios e limites estabelecidos nesta lei foram seguidos pelo Sinditest, ou seja, não há razão para retaliação por parte da administração ou chefias.
No caso da FUNPAR/HC, a greve chegou a ser judicializada pela patronal e, mesmo assim, foi mantida pelo juiz sob condições expressas de manutenção de 50% do atendimento, as quais foram atendidas.
No caso dos(as) servidores(as) técnico-administrativos(as) da UFPR, UTFPR e UNILA, as negociações sobre a reposição de trabalho não estão encerradas. Portanto, em nenhum dos casos as chefias estão autorizadas a descontar ou ameaçar os(as) trabalhadores(as) com o corte do ponto, ou com medidas de retaliação como discriminação dos(as) trabalhadores(as) que participaram da greve em relação a escala de trabalho, férias, ou outra ação similar.
A Direção do Sinditest-PR orienta aos(as) trabalhadores(as) que, diante de qualquer prática anti-sindical que ameace o direito de greve, o(a) trabalhador(a) deve remeter essa situação ao Sinditest que tomará providências necessárias, inclusive incorporando esse tema nas negociações sobre o encerramento da greve.
