CPI da violência nas universidades com reitor da USP tem poucos avanços

Ex-prefeito da Esalq se eximiu da responsabilidade de apurar o caso de violência na instituição

O reitor da Universidade de São Paulo (USP), Marco Antonio Zago, e o ex-prefeito do campus da Escola Superior de Agricultura “Luiz de Queiroz” (Esalq), o professor Marcus Vinícius Folegatti, foram chamados para prestar depoimentos na audiência da Comissão Parlamentar de Inquérito (CPI) da violência e abuso sexual nas universidades de São Paulo, nesta quarta-feria (21). A CPI foi formada para apurar alguns casos de denúncias recentes em algumas universidades paulistas.

Caso Esalq

Marcos Vinícius Folegatti, por exemplo, foi chamado com o objetivo de esclarecer quais as medidas tomadas pela faculdade quando uma estudante de 18 anos foi estuprada quando estudava no campus da Esalq, em Piracicaba, em 2002.

A estudante deu seu depoimento no dia 9 de janeiro e relatou que a convidaram para uma festa, que mais tarde se revelou fictícia. Foi dopada e estuprada por oito alunos da instituição enquanto estava desacordada. Dois dias depois, uma lista de emails contando os detalhes do estupro foi criada por alunos, divulgando o ocorrido a toda universidade.

Após o caso, ela desenvolveu uma doença autoimune rara, a colangite esclerosante, que acomete geralmente homens na faixa etária de 43 anos, que tenham sofrido um grande trauma.

A aluna nunca havia exposto publicamente o caso até 2013, quando revelou ao marido o que havia acontecido. Na época, a aluna, junto à família, entrou em contato com o prefeito do campus para pedir que fosse retirada da internet a lista de emails. Durante a CPI, Folegatti afirmou que, ao ser procurado pela família, apenas lhe foi pedido que retirasse da internet um conteúdo que estava sendo divulgado, sem que se mencionasse qual era. “Veja, eu quero deixar bem claro que em nenhum momento ela disse que havia sido estuprada”, afirmou o ex-prefeito.

Culpabilização

Além de negar que soubesse do caso, ele ainda chegou a dizer que a culpa de não haver prosseguimento na investigação da denúncia era da própria vítima. A deputada Sarah Munhoz (PCdoB) e militantes do coletivo feminista presentes na sessão responderam à afirmação do professor dizendo que é difícil que uma vítima de abuso prossiga com a denúncia se não se sentir acolhida.

O deputado Marco Aurélio de Souza (PT) considerou que mesmo após a decisão da vítima em não seguir com a denúncia, era responsabilidade da universidade apurar os fatos. “Em cima da constatação de que ocorreu um fato, me parece que nada foi feito em cima desta constatação (…) na verdade, pode não ter havido a denúncia, mas a constatação do fato houve e nesse espaço de tempo não ocorreu nada. Poderia ter sido feito alguma coisa, pois, se havia uma rede de emails, que se tornou pública, alguma medida deveria ter sido tomada”. Folegatti se defendeu reafirmando que não sabia do conteúdo dos emails e que, quando foi averiguar, eles já haviam sido apagados.

O presidente da comissão, o deputado Adriano Diogo (PT), revelou que os membros da CPI têm sido ameaçados pelos ex-alunos citados no depoimento da vítima. Ele também leu um depoimento escrito pela família da vítima, no qual se afirmava que Folegatti desestimulou que se desse prosseguimento à denúncia: “Ele foi omisso e nos disse: ‘olha, não vai fazer nada, deixa isso quieto’”.

Reitor da USP

O depoimento do reitor da USP, Marco Antônio Zago não trouxe esclarecimentos relevantes em relação ao combate ao trote, e foi, nas palavras de Adriano Diogo, “decepcionante”. Ele disse que todas as denúncias estão sendo acompanhadas pela reitoria, que delegou à Comissão de Direitos Humanos da USP (CDH-USP) a responsabilidade pela investigação das denúncias.

Marco Aurélio de Souza ressaltou os problemas no processo de sindicância, relatando o caso de uma aluna que fez uma denúncia que foi alterada ao ser escrita. O vice-diretor da Faculdade de Medicina ABC, Marco Akerman, que estava presente à sessão, também sugeriu que era necessário uma canal de comunicação mais efetivo para acolher as denúncias: “A CDH-USP não vai conseguir construir uma lógica sensível de escuta, seria necessário que houvesse um órgão intermediário”.

Problema “pontual”

Durante o tempo todo, o reitor tratou do problema como se fosse o caso de alguns alunos desviantes, e não de um problema estrutural, misturado à própria hierarquia da instituição universitária. “Eu tenho a impressão que não seria saudável nós generalizarmos”, disse ele sobre os alunos de medicina, “Há nesse conjunto de denúncias uma mescla de situações muito diversas”, disse em outro momento, mostrando como a universidade trata de cada caso como um caso específico sem conexão com a cultura do trote.

Ao final da sessão, o aluno de medicina Felipe Scalisa, um dos que tiveram a iniciativa de levar as denúncias à CPI, disse ao reitor: “O que nos fez vir à esfera pública foi que estávamos sofrendo perseguição dentro da universidade e não sabíamos o que fazer, é uma centena de alunos (que está envolvida nos trotes), não é um ou dois”.

O reitor também culpou as confraternizações dos alunos por parte da violência, dizendo que as festas na universidade e o consumo de álcool são graves problemas. Afirmou ainda que com a medida de abolirem as festas e o consumo de álcool a situação irá melhorar. A advogada Marina Ganzarolli, uma das fundadoras do coletivo feminista Dandara, da Faculdade de Direito da USP, disse em resposta: “o foco do problema não são as festas, não é o álcool, não são as confraternizações da vida estudantil. A gente não tem que ensinar as meninas a usar uma saia mais longa ou parar de beber, é preciso ensinar os alunos a não estuprar. É pra isso a gente precisa de apoio administrativo”.
